Customer Alleges Negligence Against Local Donut Shop After Coffee Spill Incident

A lawsuit has been filed against a local donut shop, alleging negligence that resulted in severe injuries to a customer. On November 18, 2025, Angel Burgos filed a complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, against McMullen Booth Donuts, LLC. The case highlights serious allegations of negligence by the defendant that led to significant harm to the plaintiff.

According to the complaint, Angel Burgos visited McMullen Booth Donuts on October 26, 2025, intending to purchase food and drink. The lawsuit claims that during this visit, the employees of McMullen Booth Donuts failed to secure the lid on a coffee cup before handing it over at the drive-thru window. This alleged oversight is said to have caused hot coffee to spill onto Burgos, resulting in severe burns. The complaint accuses McMullen Booth Donuts of failing in their duty of care towards Burgos as a business visitor by not ensuring the safety and proper handling of their products.

The plaintiff argues that due to this negligence, he suffered significant physical injuries and incurred substantial medical expenses for treatment. Furthermore, Burgos claims that these injuries have led to ongoing pain and suffering both physically and mentally. He also asserts that his ability to enjoy life has been permanently affected along with his capacity to earn wages. As stated in the filing: “Plaintiff was injured in and about his body and extremities; incurred medical expenses for treatment; endured pain and suffering; sustained permanent injury; lost wages and earning capacity.”

Burgos is seeking damages exceeding $50,000 from McMullen Booth Donuts for their alleged negligence. He demands a jury trial for all issues that are eligible for such proceedings under law. His legal representation is being handled by Gabriel Silveira from Morgan & Morgan law firm based in Tampa, Florida.

The case will be presided over by judges within the jurisdiction of Pinellas County’s Sixth Judicial Circuit Court under Case Number 25-006518-CI.
