Customer Sues Local Pizzeria Over Negligence After Stool Collapse

A woman in Florida is taking legal action against a local pizza establishment following an unfortunate incident involving a collapsing stool. Vivian Dearce-Crespo filed a complaint on February 25, 2026, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, against Florida Pizza 6 LLC, which operates under the name Jet’s Pizza.

The lawsuit stems from an incident that occurred on February 18, 2025, at the Jet’s Pizza location on West Bay Drive in Largo, Florida. According to the complaint, Dearce-Crespo was visiting the restaurant to order pizza when she sat on a stool provided for customer seating. The stool unexpectedly collapsed beneath her due to what she claims was structural failure. The plaintiff asserts that this collapse resulted from issues such as loose or missing fasteners and compromised joints. She argues that these defects were discoverable through reasonable inspection and maintenance procedures but were negligently overlooked by the defendant.

Dearce-Crespo’s complaint accuses Florida Pizza 6 LLC of negligence and negligent maintenance. She alleges that the company failed to uphold its duty to maintain its premises safely and warn customers of potential dangers. “A stool used for customer seating does not collapse in the absence of negligence when properly inspected and maintained,” states one part of her complaint. Furthermore, she contends that the defendant should have known about the stool’s unsafe condition through regular inspections and routine maintenance practices.

As a result of this alleged negligence, Dearce-Crespo claims she sustained serious injuries leading to medical expenses, pain and suffering, loss of enjoyment of life, significant scarring and disfigurement, psychological distress, loss of wages, and impairment of her working ability. Her injuries are described as permanent with ongoing effects expected into the future.

In her lawsuit, Dearce-Crespo seeks compensatory damages exceeding $50,000 along with court costs. She has also demanded a jury trial to resolve all triable issues related to her claims against Florida Pizza 6 LLC.
