The estate of a deceased nursing home resident has filed a lawsuit alleging severe negligence and breach of fiduciary duty against the operators of a Florida-based nursing facility. The complaint was filed by Stacey Ethel Morrison, representing the Estate of David George Wolf, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on November 14, 2025. The defendants named in the case are CPlace of St. Pete, LLC; Ark Post Acute Network, LLC; and Raymond Daniel Charpentier.
According to the lawsuit, David George Wolf was admitted to Carrington Place of St. Pete on November 4, 2023, where he remained until his discharge on December 19, 2023. During his stay at this facility—operated under the fictitious name owned by CPlace of St. Pete—the plaintiff alleges that Mr. Wolf suffered from inadequate care and supervision due to insufficient staffing levels and poor management practices overseen by Ark Post Acute Network and administrator Raymond Daniel Charpentier. The complaint details numerous breaches of duty that allegedly led to Mr. Wolf’s injury and subsequent death on February 4, 2024.
The plaintiff claims that the defendants violated Florida Statute §400.022 concerning residents’ rights by failing to provide adequate health care and ensure a safe environment for Mr. Wolf. “Defendants breached their duty…to properly supervise staff,” reads one section of the complaint, which further accuses them of failing to notify medical professionals about significant changes in Mr. Wolf’s condition or develop an adequate care plan for him.
The estate is seeking damages exceeding $50,000 for both non-lethal and lethal negligence counts as well as wrongful death damages under Florida law. Additionally, they accuse CPlace of St. Pete LLC specifically with breaching its fiduciary duties by diverting funds intended for patient care toward other interests—allegations supported by claims against Ark Post Acute Network LLC for aiding these breaches through financial manipulation within their corporate structure.
