Florida attorney general warns companies over links to environmental groups amid antitrust concerns

Attorney General James Uthmeier has sent letters to nearly 80 corporations linked with the U.S. Plastics Pact, the Consumer Goods Forum, and the Sustainable Packaging Coalition. The letters raise concerns that these companies’ involvement in certain environmental initiatives could violate antitrust and consumer protection laws.

“Multiple advocacy organizations have pressured companies into artificially changing the output and quality of their goods and services in way that normal market forces would not otherwise bring about,” said Attorney General James Uthmeier. “These groups were warned that their activity presents serious conflicts with antitrust and consumer protection laws, and advocacy for a particular agenda is not a basis to mislead consumers.”

The new notices follow previous correspondence sent on October 29, 2025, by Attorney General Uthmeier alongside a coalition of state attorneys general. That letter expressed concern that policies promoted by these environmental groups may conflict with the Sherman Act as well as state antitrust and consumer protection statutes.

In the latest letters, companies are informed that ongoing participation or coordination with these initiatives could expose them to potential antitrust liability. The letters point out that establishing uniform production and packaging standards—such as determining which materials are considered recyclable—may reduce competition, limit consumer choice, and lower product quality.

Attorney General Uthmeier also notes that similar industry actions were previously abandoned after legal concerns over possible antitrust violations emerged. The companies have been told they may be subject to further legal scrutiny, including subpoenas or other compulsory measures.

Each company is asked to provide a response outlining how its involvement does not violate antitrust or consumer protection laws.
