Florida Resident Sues Local Business Spray Gunner Over Premises Liability Incident

A Florida resident has taken legal action against a corporation following an unexpected incident that left him injured. Joshua Parker filed a complaint on October 15, 2025, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, accusing Titus Corp., doing business as Spray Gunner, of negligence resulting in personal injury.

The lawsuit stems from an incident on June 1, 2025, when Parker visited the defendant’s premises located at 221 Douglas Rd. E., Pinellas County. As a business invitee and customer, Parker sat on a folding chair that unexpectedly collapsed beneath him, causing him to fall violently onto the hard floor. The complaint alleges that Titus Corp., as the owner and operator of the premises, failed to maintain a safe environment for its customers and did not provide adequate warnings about potential hazards.

According to the complaint filed by Parker’s attorney Kaitlin H. Maller from Morgan & Morgan in Tampa, Florida, Titus Corp. had a non-delegable duty to ensure the safety of its premises for business invitees like Parker. The lawsuit accuses Titus Corp. of several acts of negligence: allowing a hazardous condition to exist on its premises; failing to maintain or adequately inspect the premises; neglecting to correct known dangers; and not warning customers about these dangers.

Parker claims that as a direct result of this negligence, he suffered permanent injuries including physical pain and suffering, mental anguish, disability, disfigurement, and loss of enjoyment of life. The complaint states that these injuries are either permanent or ongoing and will continue to affect Parker in the future.

The plaintiff is seeking damages exceeding $50,000 from Titus Corp., along with interest and costs associated with the case. Additionally, Parker demands a jury trial for all issues deemed triable by jury.

The case is being handled by Judge Ken Burke under Case Number 25-005803-CI. Joshua Parker is represented by attorney Kaitlin H. Maller from Morgan & Morgan law firm based in St. Petersburg.
