In a gripping case of alleged negligence, a Florida resident has taken legal action against a well-known supermarket chain following a severe injury sustained on their premises. Rosa Valdivia filed the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on February 27, 2026, accusing Publix Supermarkets, Inc. of failing to maintain safe conditions at one of its locations.

The lawsuit stems from an incident that occurred on June 3, 2025, when Valdivia visited the Publix store located at 5050 Champion Boulevard in Boca Raton for grocery shopping. During her visit, she slipped and fell in the bread aisle due to what she describes as “wet, slippery, slick, dirty and unreasonably dangerous” floor conditions. The complaint asserts that these hazardous conditions existed long enough for Publix to have been aware or should have been aware of them before Valdivia’s accident.

Valdivia contends that Publix breached its duty of care by not maintaining the premises in a reasonably safe condition and failing to correct or warn about the dangerous situation. The plaintiff claims that there were multiple employees and agents present near the wet area who could have addressed the issue but did not. This failure allegedly led to significant injuries for Valdivia, including bodily harm, pain and suffering, disability, mental anguish, and financial losses related to medical treatment and loss of earnings.

The lawsuit seeks compensatory damages from Publix Supermarkets for these injuries and losses. Valdivia is also demanding a jury trial to resolve all issues related to this case. Her legal representation is provided by Steinger, Greene & Feiner P.A., with Max B. Blackman serving as her attorney.

The case is presided over by Judge Michael A. Caruso under Case Number 502026CA002389XXXAMB Div: AO. As it unfolds in court, this case will test whether Publix met its obligations under Florida law regarding customer safety within its stores.
