Former Employee Alleges Breach of Contract Against Wealth Advisory Firm

A former financial planner is taking legal action against a wealth advisory firm, alleging breach of contract and retaliation under Florida’s Private Whistleblower Act. Ariel Moyano filed the complaint on September 11, 2025, in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, accusing Singer Wealth Advisors, LLC (SWA) of failing to pay agreed-upon wages and unlawfully terminating his employment.

The lawsuit details that Moyano began working for SWA as a Financial Planner on September 12, 2022. According to the complaint, he was promised a $70,000 annual salary with an additional $10,000 raise upon passing a Certified Financial Planner exam. The agreement also included a $5,000 holiday bonus and revenue-sharing provisions. Despite fulfilling his duties effectively until May 28, 2024, Moyano claims SWA delayed or withheld commission payments without justification. “SWA would often delay paying Mr. Moyano’s commissions for several months,” states the complaint.

Moyano repeatedly brought these issues to the attention of Steven Trachtenberg, an Investment Advisor Representative at SWA. Instead of addressing the concerns, Trachtenberg allegedly threatened Moyano’s job security if he continued to object about unpaid wages. “If Mr. Moyano kept objecting regarding his unpaid wages, the issue would not end well for [him],” Trachtenberg reportedly warned.

On May 28, 2024, Moyano was abruptly terminated by Trachtenberg who allegedly insulted him by calling him a “cancer.” The plaintiff argues this termination was retaliatory and violated Florida’s Private Whistleblower Act as it followed closely after his objections to SWA’s unlawful practices.

In addition to seeking damages exceeding $50,000 for unpaid wages and commissions under breach of contract claims, Moyano is pursuing relief under promissory estoppel and unjust enrichment theories. He argues that he relied on SWA’s promises to his detriment and that SWA benefited from his services without providing proper compensation.

Moyano is requesting judgment against Singer Wealth Advisors for damages including lost wages and benefits due to wrongful termination. He also seeks compensatory damages for emotional distress caused by the alleged unlawful actions of SWA along with attorneys’ fees and costs pursuant to Section 448.08 of Florida Statutes.

Representing Ariel Moyano is attorney Andres Kroboth from Richard Celler Legal P.A., while no defense counsel has been named yet in court documents. The case is presided over by judges within Palm Beach County’s Fifteenth Judicial Circuit under Case Number: 502025CA009300XXXAMB Div: AO.
