A former employee has taken legal action against a well-known fast-food chain, alleging a series of discriminatory practices that culminated in her wrongful termination. Nicole Torres filed a complaint on February 20, 2026, in the Circuit Court for the Sixth Judicial Circuit in Pinellas County against St. Petersburg Burgers, Inc., which operates under the Culver’s brand.

The lawsuit details a harrowing account of workplace discrimination and harassment faced by Torres during her tenure as a cashier at the restaurant located at 9046 4th St. North, St. Petersburg, Florida. According to the complaint, Torres was subjected to sexual harassment by her manager, David Ferguson, who allegedly made inappropriate physical contact and comments towards her. The situation escalated when she objected to his advances and was subsequently terminated from her position despite having received commendations for excellent customer service.

Torres claims that her dismissal was not only retaliatory but also discriminatory based on sex and disability. She disclosed her bipolar disorder to her employer before being fired and alleges that this disclosure contributed to the decision to terminate her employment. The complaint accuses St. Petersburg Burgers of violating Title VII of the Civil Rights Act of 1964 and the Americans with Disabilities Act (ADA) by failing to prevent discrimination and harassment in the workplace.

The plaintiff is seeking compensatory damages for back pay, front pay or reinstatement, punitive damages for emotional distress, pain and suffering, mental anguish, pre- and post-judgment interest, attorneys’ fees, costs, and any other relief deemed appropriate by the court. Torres argues that these actions were conducted with malice and intentional disregard for her rights.
