Grocery Delivery Man Sues Dog Owner Over Unprovoked Attack

A grocery delivery turned into a nightmare when an encounter with a customer’s dogs left a man injured, leading to a legal battle. On November 18, 2025, Nicholas Dalessandro filed a complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, against Tianzi Xie. The case revolves around an incident that occurred on June 6, 2025, when Dalessandro was delivering groceries to Xie’s residence.

According to the complaint, Dalessandro was lawfully on Xie’s property located at 547 92nd Avenue North in St. Petersburg, Florida. During his visit, he alleges that Xie’s dogs were running free and unprovokedly chased him. In an attempt to escape the pursuing canines, Dalessandro was forced to jump over a fence, resulting in bodily injuries. The plaintiff claims these injuries have led to physical and mental pain and suffering, permanent scarring and disfigurement, medical expenses, and loss of enjoyment of life.

Dalessandro’s legal action is based on strict liability under Florida Statute §767.04, which holds dog owners liable for damages caused by their pets’ actions. He asserts that Xie had knowledge of the dogs’ presence on her property and is therefore responsible for the attack’s consequences. “As a direct and proximate result of the attack,” states the complaint, “Nicholas Dalessandro suffered physical injury…and said injuries and losses are either permanent or continuing in nature.”

The plaintiff seeks compensatory damages exceeding $50,000 from Xie for his injuries and associated losses. He also requests any additional relief deemed just by the court. The lawsuit emphasizes that Dalessandro’s claims surpass the minimum jurisdictional threshold required by the court for such cases.

Representing Dalessandro is attorney Paul B Fulmer II from Morgan & Morgan Tampa PA law firm. The case has been assigned Case Number: 25-006509-CI and will be presided over by judges from the Sixth Judicial Circuit Court in Pinellas County.
