Homeowner Accuses Contractors and HOA of Negligence Leading to Property Damage

A Palm Beach County resident is embroiled in a legal battle over alleged negligence and breach of covenants related to her home. Elaine Edwards filed a complaint on November 21, 2025, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Garabar, Inc., Ara Garibian, Vanessa Rivera, PGA Patio Homeowners’ Association, Inc., RealManage, LLC, and United Community Management Corp.

The case revolves around claims of negligence in the design and construction work performed on Edwards’ dwelling at 206 Old Meadow Way, Palm Beach Gardens. According to the complaint, Garabar, Inc., along with Ara Garibian and Vanessa Rivera—licensed contractors—were hired by the PGA Patio Homeowners’ Association to replace the flat roof of Edwards’ home. The plaintiff alleges that these defendants failed to obtain necessary building permits and did not adhere to applicable building codes and industry standards. This alleged negligence led to water intrusion causing property damage and personal injuries including respiratory issues for Edwards. She claims ongoing damages due to additional living expenses during repairs and permanent or continuing losses affecting her quality of life.

Edwards also accuses the PGA Patio Homeowners’ Association and its property management agents—RealManage, LLC and United Community Management Corp.—of failing to maintain her home’s exterior properly. She asserts that their negligence allowed water intrusion into her dwelling for an extended period despite being notified of the issue. As a result, she suffered further property damage as well as bodily injuries leading to pain and suffering.

In her lawsuit, Edwards seeks judgment against all defendants for damages exceeding $50,000 exclusive of interest and fees. She demands compensation for ongoing losses related to property damage and personal injury alongside attorney’s fees under various Florida statutes. Furthermore, she requests a jury trial.
