In a gripping legal battle, an individual has taken on several major medical institutions over a slip-and-fall incident that allegedly resulted in serious injuries. Marlene Frazzini filed a complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on November 13, 2025, against National Spine and Pain Centers, LLC, along with its associated entities.
The case revolves around an incident that occurred on November 14, 2023. According to the complaint, Frazzini was visiting the National Spine & Pain Centers office located at 5365 West Atlantic Avenue in Delray Beach for an appointment when she slipped on water that had accumulated near the entrance due to inclement weather. The lawsuit alleges that the defendants were aware of the potential for such hazardous conditions but failed to take necessary precautions or warn visitors about the danger. “At all times material hereto,” the document states, “it was foreseeable to the Defendant…that transitory substance or water would accumulate in the entranceway inside its office because it was or had been raining.”
Frazzini’s attorney argues that despite having knowledge of these conditions and possessing resources like rubberized floor mats to mitigate such risks, the defendants neglected their duty of care. It wasn’t until after Frazzini’s fall that a mat was placed at the site of her accident. The plaintiff claims this negligence led to severe physical injuries and emotional distress. The complaint accuses the defendants of failing to maintain safe premises and not adhering to reasonable safety protocols, thereby violating their duty as business operators under Florida law.
The lawsuit seeks damages exceeding $50,000 for medical expenses incurred due to her injuries and compensation for pain and suffering, loss of wages, and diminished quality of life. Additionally, Frazzini demands a jury trial to resolve these allegations against National Spine and Pain Centers LLC and its affiliates.
Representing Marlene Frazzini is Timothy J. Murphy from The Murphy Law Firm based in Palm Beach Gardens. The case is presided over by Judge Michael A. Caruso under Case ID 502025CA011872XXXAMB.
