A lawsuit seeking damages exceeding $50,000 has been filed over an alleged incident involving negligent operation of a motor vehicle that resulted in significant injuries and losses for the plaintiff. The complaint states that Nguyen “did so carelessly and negligently drive, manage, maintain and operate the motor vehicle so that it collided with Plaintiff’s…vehicle.” The document further asserts that Nguyen owed both Brown and the public “the duty to exercise reasonable care and diligence in the operation of a motor vehicle and to abide by the traffic laws of the State of Florida in the operation of that automobile.”

The plaintiff claims that this duty was breached at the time and place described in the complaint. As a direct result of this alleged negligence, Brown reports suffering bodily injury as well as resulting pain and suffering, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, expenses related to hospitalization and medical care, loss of earnings and earning ability, and aggravation of pre-existing conditions. The filing notes these losses are either permanent or continuing in nature: “These losses are either permanent or continuing and Plaintiff will suffer the losses in the future.”

The complaint outlines jurisdictional facts indicating both parties were residents of Pinellas County at all pertinent times or otherwise subject to Florida law regarding service of process if residency status changed or whereabouts became unknown. It specifies that venue is proper because “the incident at issue took place in Pinellas County.” The suit is brought under a count labeled Negligence against Thien H. Nguyen.

Brown seeks judgment against Nguyen for damages exceeding $50,000 plus costs associated with legal proceedings and any other remedies allowable by law. The plaintiff also demands a trial by jury on all issues so triable.
