A Florida resident has taken legal action against a major retail corporation and its associates, alleging negligence after suffering a severe fall on their premises. On October 16, 2025, Michael DeMoss filed a complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, against Walgreens.com, Inc., CBRE, Inc., and Jolly Roofing.
The case revolves around an incident that occurred on August 23, 2024. DeMoss claims he was visiting a Walgreens store located at 10121 Seminole Blvd in Seminole, Florida when he fell due to a hazardous condition on the floor. The complaint states that Walgreens owned and operated the store while CBRE was responsible for its property management. Furthermore, Jolly Roofing had been contracted by CBRE to perform repairs at the location on the day of the incident. DeMoss alleges that these entities failed to maintain safe conditions on the premises, leading to his fall and subsequent injuries.
According to DeMoss’s complaint, Walgreens is accused of negligence and premises liability for not ensuring their store was safe for customers. The lawsuit details several alleged failures by Walgreens: improper maintenance of the floor area where DeMoss fell; neglecting necessary inspections that could have prevented such hazards; allowing dangerous conditions to persist; and failing to adhere to industry standards or contractual obligations meant to ensure safety. As a result of these alleged oversights, DeMoss suffered severe injuries including bodily harm, pain and suffering, disability, mental anguish, and loss of earning capacity.
DeMoss seeks damages exceeding $50,000 from each defendant—Walgreens.com Inc., CBRE Inc., and Jolly Roofing—along with interest and costs associated with the lawsuit. He demands compensation for medical expenses incurred due to his injuries as well as any future costs related to ongoing treatment or rehabilitation.
Representing Michael DeMoss is attorney Jeremy Clark from Clark Law based in St. Petersburg, Florida. The Case Number is 25-005819-CI.
