Plaintiff Accuses Property Owners of Negligence Following Slip-and-Fall Incident

A slip-and-fall incident at a Boca Raton property has led to a lawsuit seeking damages exceeding $50,000. On November 14, 2025, Yolibeth Arroyo Fonseca filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Savannah Place (M-O) Owner LLC and Morgan Properties Management Company, LLC.

The lawsuit stems from an incident on May 27, 2024, when Fonseca was reportedly injured due to hazardous conditions at the premises located at or near 22356 Calibre Court. According to the complaint, Fonseca was lawfully present as an invitee when she encountered sludge and/or sewage on a walkway, which caused her to slip and fall. The plaintiff accuses Savannah Place (M-O) Owner LLC of negligence for failing to maintain safe premises and not warning about known dangers. “The Defendant had a non-delegable duty to make its premises reasonably safe,” states the complaint.

In addition to targeting Savannah Place (M-O) Owner LLC, the lawsuit also names Morgan Properties Management Company as a defendant. The complaint alleges that Morgan Properties was contracted by Savannah Place to maintain the property but failed in its duties by allowing dangerous conditions to persist. “Defendant breached the duty owed to Plaintiff in that it negligently failed to perform its work in a reasonable manner,” claims the document.

Fonseca’s injuries are described as severe and lasting. She is reported to have suffered bodily harm resulting in pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, medical expenses, loss of earnings capacity, and aggravation of pre-existing conditions. These losses are claimed to be either permanent or ongoing.

The plaintiff seeks judgment against both defendants for damages along with interest and costs. Additionally, Fonseca demands a jury trial on all issues deemed triable by right.
