In a recent legal filing, a woman has taken action against two prominent companies, alleging negligence that led to her severe injuries. On November 21, 2025, Colleen Stocker filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against The Blue Dog in Boca, Inc., and Simon Property Group, Inc. The case brings to light issues of safety and responsibility in public spaces.
According to the complaint, on December 30, 2024, Colleen Stocker was injured at an outdoor dining area managed by The Blue Dog in Boca and Simon Property Group. Stocker claims she fell due to an “unlevel, raised, elevated” condition at the entrance of the restaurant located at 6000 Glades Rd Suite 1008C in Boca Raton. She asserts that both defendants failed in their duty to maintain a safe environment for patrons like herself. “The premises were not properly constructed or designed,” states the complaint, which further details numerous alleged failures such as improper stair riser height and lack of adequate handrails.
Stocker’s allegations are rooted in what she describes as a breach of non-delegable duties by both defendants. She accuses them of negligence for not only failing to maintain the premises but also for not warning about or correcting known hazardous conditions. The complaint lists specific oversights including failure to install proper hand railings and allowing misaligned sections with abrupt changes in elevation. It argues that these conditions were reasonably foreseeable hazards that should have been addressed by those responsible for maintaining the property.
The plaintiff is seeking damages exceeding $50,000 for her injuries which include permanent bodily harm and various forms of suffering such as mental anguish and loss of enjoyment of life. Stocker emphasizes that these injuries have resulted in significant medical expenses and loss of earnings both past and future. She requests judgment against both defendants along with interest and costs incurred from this legal action.
