A Florida resident has filed a lawsuit against a major retail chain, claiming negligence after suffering injuries from a fall inside one of its stores. Randall McGibbon lodged the complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on February 23, 2026, accusing Winn-Dixie Stores, LLC of failing to maintain safe premises.

The incident occurred on April 5, 2025, when McGibbon visited the Winn-Dixie store located at 1296 County Road 1 in Dunedin, Pinellas County. McGibbon’s lawsuit outlines several accusations against Winn-Dixie Stores for breaching their duty of care. The plaintiff claims that the company failed to maintain safe conditions on their property by not keeping floors in reasonable condition and neglecting to warn customers about latent dangers. Additionally, McGibbon accuses Winn-Dixie of failing to inspect their premises properly and creating hazardous conditions. According to the complaint, these negligent conditions were either known or should have been known by Winn-Dixie due to their existence over a sufficient period.

The legal action seeks damages exceeding $50,000 exclusive of costs and interest. The plaintiff demands compensation for medical expenses related to hospitalization and treatment following the accident. Furthermore, McGibbon is pursuing relief for lost earnings and diminished earning capacity resulting from his injuries. His legal team emphasizes that these injuries are permanent or continuing in nature and will cause ongoing physical and mental distress.
