Plaintiff Accuses Retailer Ross Dress for Less of Negligence Following Slip-and-Fall Incident

A slip-and-fall incident at a popular discount retail store has led to a legal battle over alleged negligence. Susana Pinto filed a complaint against Ross Dress for Less, Inc., doing business as DD’s Discounts, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on November 24, 2025. The lawsuit accuses the defendant of failing to maintain safe premises.

The case stems from an incident on December 4, 2024, when Pinto visited the DD’s Discounts store located at 3403 S Congress Ave in Palm Springs, Florida. According to the complaint, while walking near the bathroom area of the store, Pinto slipped and fell on what she describes as vomit or another liquid substance that had accumulated on the floor. She claims that this hazardous condition was not addressed by the store’s management or staff and that no warning signs were placed to alert customers of potential danger.

Pinto’s lawsuit alleges that Ross Dress for Less failed in its duty to provide a reasonably safe environment for its patrons. The complaint outlines several specific accusations against the retailer: neglecting to maintain a clean and safe floor space by allowing liquids to accumulate; failing to warn customers about existing hazards; not placing barricades or wet floor signs; and not removing dangerous substances promptly. Furthermore, it is claimed that these conditions were known or should have been known by the defendant due to their frequency and duration.

As a result of her fall, Pinto asserts she suffered severe injuries leading to physical pain, mental anguish, disability, disfigurement, loss of enjoyment of life, and financial losses due to medical expenses and impaired earning capacity. The plaintiff argues that these injuries are either permanent or will continue into the future.

In seeking justice through this lawsuit, Pinto demands judgment for damages exceeding $50,000 exclusive of interest and costs. She also requests additional relief deemed appropriate by the court along with a jury trial on all issues triable as a matter of right.
