Plaintiff Alleges Former Employer Engaged in Age Discrimination

A former employee has taken legal action against his previous employer, alleging age discrimination in violation of the Florida Civil Rights Act. Mark D. Miller filed a complaint on November 4, 2025, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Service Experts Skilled Trades LLC. The lawsuit claims that Miller was unfairly terminated due to his age and seeks damages exceeding $50,000.

Mark D. Miller, who had been employed by Service Experts Skilled Trades LLC after their acquisition of Xtra Mile Cooling, Plumbing & Electric in April 2024, claims that he faced discrimination based on his age. According to the complaint, Miller was hired as a General Manager by Xtra Mile in March 2023 and maintained an exemplary performance record throughout his tenure. However, he alleges that despite his strong performance and lack of any disciplinary actions or warnings regarding his conduct, he was terminated on June 26, 2024. The company cited unprofessional behavior as the reason for termination but allegedly referred to him as a “dinosaur” and treated him more harshly than younger employees accused of similar behavior.

Miller asserts that following his termination, Service Experts falsely informed other employees and the Equal Employment Opportunity Commission (EEOC) that he had voluntarily resigned. He argues that this constitutes intentional discrimination and unlawful employment practices under Chapter 760 of the Florida Statutes. The plaintiff has fulfilled all conditions precedent for bringing this action by filing charges with both the EEOC and the Florida Commission on Human Relations over six months prior to filing this lawsuit.

The lawsuit seeks various forms of relief from the court including equitable relief mandating compliance with relevant laws by Service Experts Skilled Trades LLC; compensatory damages for emotional distress, mental pain and suffering; lost wages; punitive damages; attorney’s fees; costs; prejudgment interest; and potentially reinstatement to his former position. Additionally, Miller demands a jury trial for all issues deemed triable.
