A Florida resident has taken legal action against a condominium association, alleging negligence that led to significant personal injuries. Kathie Capps filed a complaint on November 24, 2025, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, accusing Harbor Club Condominium Association, Inc. of failing to maintain safe premises at their Palm Harbor location.

According to the lawsuit, Kathie Capps visited the Harbor Club Condominiums as a business invitee on August 14, 2025. During her visit, she claims she fell down an exterior staircase due to uneven stairs and inadequate lighting. The complaint details that Capps was lawfully on the premises when she suffered from various injuries including pain and suffering, disability, disfigurement, and mental anguish as a result of this fall. The plaintiff asserts that these injuries were caused by the defendant’s failure to uphold their duty of care by not maintaining safe conditions or warning guests about potential hazards.

The allegations against Harbor Club Condominium Association include multiple counts of negligence. The plaintiff accuses them of failing to properly maintain the staircase and its lighting, which created hazardous conditions for visitors like herself. Furthermore, Capps argues that there was a lack of adequate inspection and warning systems in place despite knowledge of prior incidents at the location. She also claims that there were insufficient policies and staffing to address such dangerous conditions effectively.

Capps is seeking damages exceeding $50,000 for her injuries and associated losses. She demands a jury trial to determine fair compensation for her medical expenses, loss of earnings capacity, and other related damages resulting from what she describes as ongoing or permanent impairments due to the incident.
