A Florida resident has filed a lawsuit against a local condominium association, alleging negligence that led to severe injuries. On September 12, 2025, Christian Carr lodged a complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, against Lake Clarke Gardens Condominium, Inc. The plaintiff is seeking damages exceeding $50,000 for an incident that occurred earlier this year.
According to the complaint, on February 12, 2025, Christian Carr was visiting Lake Clarke Gardens, an active adult community located at 2981 Florida Mango Road in Lake Worth. During his visit to Building No. 26 within the community, Carr slipped and fell on a wet exterior staircase that had been painted but allegedly not properly maintained by the condominium association. The fall resulted in significant injuries to Carr, prompting him to file this lawsuit.
Carr’s legal team argues that Lake Clarke Gardens failed in its duty to maintain safe premises for residents and visitors alike. The complaint accuses the defendant of multiple acts of negligence including failing to maintain or adequately inspect the staircase and failing to warn about potential hazards. “Defendant negligently failed to maintain its premises in a reasonably safe condition,” reads one section of the filing. Furthermore, it alleges that Lake Clarke Gardens did not comply with applicable building and safety codes which contributed to creating a hazardous environment.
The lawsuit also claims that Lake Clarke Gardens had both statutory and contractual obligations under Florida Statutes Chapter 718 and its own governing documents to ensure safety measures were met. The failure to meet these obligations allegedly resulted in Carr’s accident and subsequent injuries.
Christian Carr is seeking compensatory damages for pain and suffering, medical expenses, loss of earnings capacity, as well as other losses related to his injuries. His attorneys are demanding a jury trial where they hope a fair judgment will be rendered based on Article 1, Section 21 of the Florida Constitution.
Representing Christian Carr is Thomas J. Jerla Jr., Esq., from Morgan & Morgan P.A., a well-known law firm specializing in personal injury cases. The case has been assigned Case Number: 502025CA009328XXXAMB Div: AO and will be presided over by judges from the Fifteenth Judicial Circuit Court in Palm Beach County.
