Plaintiff Alleges Negligence Against Convenience Store Over Slip-and-Fall Incident

A serious slip-and-fall incident at a convenience store has led to a legal battle, as a customer claims negligence resulted in significant injuries. On November 25, 2025, MD Dulal Mia filed a complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, against Wawa, Inc., Wawa Florida, LLC, and Michael Katze. The lawsuit alleges that the defendants failed to maintain safe premises at Wawa Store #5362 in Boynton Beach, resulting in Mia’s accident and subsequent injuries.

According to the complaint, on November 26, 2023, Mia was shopping at the Wawa store located at 2505 W. Woolbright Rd., Boynton Beach when he slipped on liquid near the entrance. The liquid is believed to have come from condensation from a cooler or another source. The plaintiff argues that this constituted a dangerous condition that the store should have addressed. Mia contends that both Wawa entities and store manager Michael Katze had a duty to ensure customer safety by maintaining dry floors and providing adequate warnings about potential hazards.

The lawsuit accuses Wawa of negligence for failing to prevent or warn about the dangerous condition. “WAWA knew or should have known of said dangerous condition but failed to do so or to warn of such danger,” states the complaint. Additionally, it alleges that Katze did not adequately supervise employees or implement proper safety protocols to address wet floors promptly. The complaint highlights multiple breaches of duty by both Wawa and Katze, including failure to inspect and maintain safe premises and failure to provide sufficient warnings about slippery conditions.

Mia seeks compensation for various damages resulting from his fall. These include past and future pain and suffering, physical and mental injury, scarring, disfigurement, emotional distress, medical expenses (both past and future), loss of earning capacity, and diminished quality of life. He demands judgment against both Wawa entities and Michael Katze for these damages along with recoverable costs.
