Plaintiff Alleges Negligence Against Fast-Food Chain Over Chair Collapse Incident

A Florida resident has taken legal action against a well-known fast-food chain, alleging negligence that led to personal injury. Shane Davis filed a complaint on September 30, 2025, in the Circuit Court of Pinellas County, Florida, against Chipotle Mexican Grill, Inc., and an individual identified as John Doe.

The lawsuit stems from an incident on May 30, 2025, when Davis visited a Chipotle restaurant located at 10160 Ulmerton Rd in Largo, Pinellas County. According to the complaint, Davis was injured when a chair he sat on collapsed unexpectedly. The plaintiff asserts that both defendants had a duty to ensure the safety of their premises and failed to maintain the chairs in a safe condition or warn customers of potential hazards. “Defendant breached these duties by allowing chairs not capable of supporting persons of foreseeable weight loads,” states the complaint.

Davis accuses Chipotle Mexican Grill, Inc., of negligence for not maintaining or inspecting the chairs adequately and failing to warn patrons about their potentially dangerous condition. The lawsuit claims that this negligence resulted in Davis suffering significant injuries including pain and suffering, disability, disfigurement, and mental anguish. Furthermore, it is alleged that these injuries have caused loss of earnings and enjoyment of life.

The complaint also targets John Doe, identified as the manager responsible for overseeing operations at the restaurant. It alleges that he failed to enforce company policies regarding customer safety and did not properly train staff on inspecting chairs or warning customers about hazards. “John Doe negligently failed to prevent reasonably foreseeable injuries,” reads one accusation.

Shane Davis seeks damages exceeding $50,000 from each defendant for his injuries and demands a jury trial. He argues that his losses are either permanent or ongoing and will continue into the future.

Representing Shane Davis is attorney Robert F. McLaughlin from Morgan & Morgan Tampa P.A., based in Tampa, Florida. The case has been assigned Case Number: 25-005453-CI and will be presided over by judges from the Circuit Court in Pinellas County.
