Plaintiff Alleges Negligence Against Local Business Following Gate Accident

A Florida resident has taken legal action against a local business following a harrowing incident involving an unsecured gate. On October 11, 2025, Bruce Blasko filed a complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, accusing Lake Worth Drive-In Theatre & Swap Shop, Inc., of negligence after an accident that left him with severe injuries.

According to the complaint, Bruce Blasko was involved in an accident on October 12, 2023, while visiting the Lake Worth Drive-In Theatre & Swap Shop located at 3438 Lake Worth Road. As he was leaving the parking lot at a slow speed of approximately 2-3 miles per hour, Blasko had to make a small U-turn due to the layout of the exit lanes. It was during this maneuver that an improperly secured gate swung towards his vehicle and caused significant damage. The complaint details how the gate penetrated through his car’s engine and dashboard and narrowly missed causing serious harm to Blasko himself. The impact resulted in physical injuries for which Blasko is seeking compensation.

Blasko’s lawsuit claims that Lake Worth Drive-In Theatre & Swap Shop failed in its duty to maintain safe premises for its patrons. The plaintiff argues that as a business invitee lawfully on the premises, he was owed a non-delegable duty by the defendant to ensure safety and prevent hazards such as unsecured gates. The complaint alleges that the defendant’s negligence created a dangerous condition by not securing the gate properly or warning visitors about potential risks. Furthermore, it accuses Lake Worth of failing to inspect their premises adequately—a reasonable inspection would have revealed such defects—and thereby breaching their duty of care.

The damages sought by Bruce Blasko exceed $50,000 exclusive of interest and attorney fees. He is pursuing compensation for severe injuries including disability, disfigurement, mental anguish, loss of enjoyment of life, medical expenses incurred due to hospitalization and treatment of his injuries, physical handicap, and loss of earning capacity. These injuries are described as either permanent or continuing in nature with expected future losses and impairments.
