Plaintiff Alleges Negligence Against Local Gas Station Following Slip-and-Fall Incident

A Palm Beach County resident has filed a lawsuit against a local gas station, alleging negligence after a slip-and-fall incident. Herman Baty initiated the complaint on October 9, 2025, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, targeting Cole BJ Portfolio II LLC, operating as BJ’s Gas Station, and an unnamed manager referred to as John Doe.

According to the complaint, Baty claims that on April 17, 2025, he visited BJ’s Gas Station located at 1540 Boynton Beach Blvd., Boynton Beach, FL. During his visit, he allegedly slipped and fell due to “a slippery, greasy stain accumulation” near the gas pump area. The plaintiff argues that this hazardous condition was due to negligence by the defendants in maintaining safe premises for their customers. The lawsuit details multiple alleged failures by the defendants to ensure safety standards were met. These include not keeping the premises free from foreign substances and failing to use slip-resistant materials on surfaces. The complaint states that these oversights led directly to Baty’s fall and subsequent injuries.

Baty accuses Cole BJ Portfolio II LLC of breaching its duty of care by allowing dangerous conditions to persist on its property. The lawsuit claims that the company failed in various aspects such as maintaining safe walking surfaces and not adequately inspecting or correcting known hazards. Similarly, John Doe is accused of neglecting his managerial responsibilities by not ensuring regular inspections and maintenance of the premises.

The plaintiff seeks damages exceeding $50,000 for physical injuries sustained from the fall. He alleges these injuries have resulted in ongoing pain and suffering, mental anguish, medical expenses, lost earnings potential, and diminished quality of life. Baty requests a jury trial to determine fair compensation for his losses.
