A Florida woman has filed a lawsuit against a local recreation corporation, alleging negligence after suffering injuries from a malfunctioning treadmill. Sherri Secunda-Plosker initiated the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on November 11, 2025, targeting Kings Point Recreation Corporation, Inc. as the defendant.
The case centers around an incident that occurred on April 5, 2022, when Secunda-Plosker was using a treadmill at the defendant’s premises located at or near 6561 Flanders Way, Delray Beach. According to the complaint, while walking on the treadmill, it malfunctioned causing her to fall and sustain injuries. At the time of the incident, Secunda-Plosker was considered a guest or invitee of Kings Point Recreation Corporation and was conducting herself in what she describes as “a reasonable and prudent manner for her own safety.”
The plaintiff argues that Kings Point Recreation Corporation owed her a duty of care to maintain its premises in a reasonably safe condition. This includes inspecting for any dangerous conditions and providing warnings if such conditions existed. The complaint asserts that Kings Point knew or should have known about the defective treadmill but failed to take corrective action or warn users of its dangers.
Secunda-Plosker’s allegations include that Kings Point negligently maintained its premises by not addressing or warning about the hazardous condition posed by the malfunctioning treadmill. The legal document claims that this negligence resulted in significant physical and emotional distress for Secunda-Plosker. She details suffering from disability, disfigurement, pain and suffering, mental anguish, loss of capacity for enjoyment of life, income loss, diminished earning capacity as well as incurring medical expenses related to hospitalization and therapy.
In seeking justice through this lawsuit, Secunda-Plosker demands judgment against Kings Point Recreation Corporation exceeding $50,000—exclusive of interest and costs—and requests any other relief deemed reasonable by the court. Furthermore, she has called for a jury trial to address all triable issues presented in this case.
