Harold Sussman, acting as the personal representative of Jacqueline Sussman’s estate, has filed a lawsuit against a well-known pharmacy chain and its store manager following a tragic incident that resulted in severe injuries and subsequent death. The complaint was lodged on November 7, 2025, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, naming Holiday CVS L.L.C. and Ruel Tulloch as defendants.
The case revolves around an unfortunate event that occurred on July 8, 2024, at a CVS store located at 6846 Okeechobee Blvd in West Palm Beach. According to the complaint, Jacqueline Sussman was shopping for water when she was struck by an improperly stacked water display. The lawsuit claims that this negligent stacking caused a column of water cases to collapse onto her, leading to severe injuries that ultimately resulted in her death. Harold Sussman alleges that both Holiday CVS L.L.C. and Ruel Tulloch failed in their duty to maintain a safe environment for customers.
The complaint outlines several accusations against the defendants. It asserts that Holiday CVS L.L.C., as the owner and operator of the premises, had actual knowledge of the hazardous condition or should have known about it through reasonable care. Furthermore, it accuses Ruel Tulloch of failing to conduct adequate inspections and not taking necessary precautions to prevent such dangerous conditions from arising. “The Defendant breached its duty to Plaintiff by negligently creating and/or allowing a hazardous condition,” states the complaint.
In seeking justice for Jacqueline Sussman’s untimely demise, Harold Sussman is pursuing damages exceeding $50,000 under Florida’s Wrongful Death Act. The plaintiff demands compensation for various losses including mental anguish suffered by survivors, medical expenses incurred before death, funeral costs, loss of companionship and support from Jacqueline Sussman, and any other relief deemed appropriate by the court.
