Plaintiff alleges negligence against property management company after trip-and-fall incident

In a recent legal filing, a resident of Pinellas County has brought a lawsuit against a property management company for alleged negligence leading to personal injury. Ninfa Maria Kuzmitski filed the complaint in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, on February 25, 2026, naming Vesta Property Services, Inc. as the defendant.

The case revolves around an incident that occurred on April 11, 2025, when Kuzmitski was visiting premises managed by Vesta Property Services at 8141 54th Ave N, St Petersburg, FL. As per the complaint, Kuzmitski was lawfully present as a business invitee when she tripped over an unmarked raised piece of concrete on the pathway leading to the building’s entrance. The plaintiff alleges that this hazardous condition resulted from negligence on the part of Vesta Property Services. According to the complaint, “the Defendant owed to its business invitees a duty to provide a reasonably safe environment,” which they allegedly breached by failing to maintain safe premises and neglecting to warn visitors about potential dangers.

Kuzmitski claims that Vesta Property Services failed in several specific duties: maintaining the floor in a safe condition; warning about existing dangers; placing barricades or markers to alert visitors; correcting known hazards; and generally ensuring proper care and maintenance of their property. The plaintiff asserts that these failures led directly to her fall and subsequent injuries. She describes her injuries as severe and permanent, encompassing physical and mental pain, disability, disfigurement, mental anguish, loss of enjoyment of life, loss of earnings capacity, and incurring significant medical expenses.

In seeking justice through this lawsuit, Kuzmitski demands judgment for damages exceeding $50,000 along with costs and interest from Vesta Property Services. She is also asking for any additional relief deemed appropriate by the court. The plaintiff emphasizes her right to have these issues resolved by a jury trial.
