During his work, Galli leaned on a deck railing that unexpectedly gave way, causing him to fall into a pond below. The fall resulted in permanent injuries and significant damages for Galli. The plaintiff claims that Portera knew or should have known about the unsafe condition of the deck railing and failed to warn him of this danger.
Galli’s lawsuit accuses David Matthew Portera of negligence for not maintaining the deck and its railing properly. According to the filing, Portera had a non-delegable duty to ensure the safety of those invited onto his property by taking reasonable steps to maintain safe conditions.
