A Cape Coral resident has filed a lawsuit against a Boynton Beach property owner, alleging negligence that led to severe injuries. Lori Shumway initiated the complaint on August 28, 2025, in the Circuit Court of Palm Beach County, Florida, targeting Congress Ave Boynton, LLC.

According to the court documents, Lori Shumway visited the premises owned by Congress Ave Boynton, LLC on March 26, 2025. The property located at 1325 South Congress Avenue in Boynton Beach includes an office and medical building with associated walkways open to the public. Shumway claims that while walking on the exterior premises, she tripped and fell due to loose landscaping rocks that had migrated onto the walkway. This incident resulted in her sustaining permanent and severe bodily injuries. The complaint states that “the surface of the outdoor walkway was in a dangerous, improperly maintained condition” which created a hazard for pedestrians.

Shumway’s legal representation argues that Congress Ave Boynton, LLC had a non-delegable duty to ensure a safe environment for its business invitees like Shumway. The plaintiff alleges that the defendant failed in their duty by not maintaining safe walkways and not providing adequate warnings about potential hazards such as loose rocks. Furthermore, it is claimed that there was no physical barrier separating the walkway from the adjacent landscaping area, making it difficult for visitors to distinguish between them visually.

The lawsuit accuses Congress Ave Boynton, LLC of several acts of negligence including failing to inspect or maintain safe conditions on their walkways and neglecting to warn visitors about known dangers. It also mentions inadequate supervision and retention of employees responsible for maintenance tasks. As per Shumway’s claim: “Defendant knew or should have known of a dangerous condition on the Premises—specifically loose landscaping rocks.”

Lori Shumway seeks judgment for damages exceeding $50,000 exclusive of costs and interest from Congress Ave Boynton, LLC. She demands compensation for medical expenses incurred due to her injuries along with loss of future earning capacity among other damages.

Representing Lori Shumway is The Law Offices of Anidjar & Levine P.A., based in Fort Lauderdale with contact details provided within court filings. No specific judge is mentioned but case identification is marked under Case Number: 502025CA008770XXXAMB Div: AF.
