A Clearwater resident has filed a lawsuit against a major home improvement retailer, alleging negligence that led to severe injuries. Eric Biron submitted the complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on November 3, 2025, targeting The Home Depot, Inc., and an unnamed store manager referred to as John Doe.

The case revolves around an incident that occurred on April 23, 2025, at a Home Depot store located at 30144 US Hwy 19 N in Clearwater. Biron claims he was injured when a stack of lumber fell on him while he was shopping for materials. The lawsuit accuses The Home Depot and its employees of failing to maintain a safe environment for customers by negligently storing lumber and not warning patrons about potential hazards. “Defendant’s employees had a duty to exercise reasonable care,” states the complaint, which further alleges that this duty was breached through various negligent actions including improper storage practices and inadequate safety measures.

Biron asserts that as a result of these failures, he sustained permanent bodily injuries requiring medical treatment such as shoulder surgery. He is seeking damages exceeding $50,000 for pain and suffering, loss of earnings, medical expenses, and other related costs. The complaint also accuses John Doe, the store manager at the time of the incident, of failing to ensure customer safety by not adequately training staff or addressing known risks associated with lumber storage.

The plaintiff’s attorney argues that both The Home Depot and its store manager were directly responsible for creating an unsafe shopping environment. They are accused of multiple counts of negligence including failing to inspect the premises properly and neglecting corporate policies designed to prevent such incidents. “Plaintiff will suffer losses in the future,” notes the complaint regarding Biron’s ongoing physical impairments and financial burdens due to his injuries.
