Plaintiff alleges negligence against Rumfish Beach Resort following injury incident

A Pinellas County resident has filed a lawsuit against a local resort, alleging negligence after suffering injuries from a fall on the premises. On October 31, 2025, Tod William Hess filed a complaint in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, against 5500-5600 Gulf Blvd. IG LLC, doing business as Rumfish Beach Resort by Tradewinds.

According to the complaint, Hess was visiting Rumfish Beach Resort as a guest and business invitee on July 28, 2025. While descending an exterior stairway at the resort located at 6000 Gulf Blvd., St Pete Beach, FL, he slipped and fell due to wet and slippery conditions. The plaintiff claims that the stairs were not only dirty but also lacked anti-slip treads, rendering them unsafe for use. Hess accuses Rumfish Beach Resort of negligence in maintaining its premises safely for guests. He alleges that the resort’s agents and employees failed to inspect or correct this hazardous condition despite having exclusive control over the area.

The lawsuit details several allegations against Rumfish Beach Resort: allowing dangerous conditions to persist on their property where guests were expected to walk; failing to inspect or repair these hazards; neglecting to install adequate safety measures like anti-slip treads; and not warning guests about potential dangers. Hess argues that these failures constitute a breach of duty of care owed by the resort to its invitees.

As a result of his fall, Hess asserts he sustained severe injuries affecting his body and extremities, leading to pain, physical handicap, lost wages, diminished earning capacity both past and future, aggravation of pre-existing conditions, and an inability to maintain his usual lifestyle—all described as permanent and ongoing issues. Furthermore, he claims significant medical expenses incurred due to his injuries will continue into the future.

Hess seeks damages exceeding $50,000 from Rumfish Beach Resort for their alleged negligence. He requests judgment for damages along with a jury trial on all triable issues related to this case.
