Plaintiff alleges negligence against towing company after beachside mishap

A Florida resident has taken legal action against a towing company following a harrowing incident that left her with significant injuries. On February 27, 2026, Darlene Godfrey filed a complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, against G & S Towing Recovery Services Inc., alleging negligence and seeking damages exceeding $50,000.

According to the complaint, Darlene Godfrey claims that on October 25, 2025, she hired G & S Towing Recovery Services Inc. to tow her vehicle from Pass-a-Grille Beach. The plaintiff asserts that the defendant had a duty to maintain their tow truck in a safe condition and to warn her of any potential dangers associated with towing her vehicle. However, Godfrey alleges that G & S Towing failed in these duties by not securing her vehicle properly on the tow truck and neglecting necessary maintenance of their equipment. Additionally, she accuses the company of inadequate employee training regarding inspection and maintenance procedures for their tow trucks.

The complaint details how these alleged failures resulted in a traumatic incident where Godfrey was struck by part of her own vehicle during the towing process. This accident reportedly caused her to be thrown to the ground, leading to severe personal injuries including pain and suffering, disability, disfigurement, permanent scarring, mental anguish, and other long-term effects such as loss of earning capacity and ongoing medical expenses.

Godfrey’s legal team argues that these injuries were directly caused by the negligence of G & S Towing Recovery Services Inc., and they are seeking compensatory damages for both past and future losses incurred due to this incident. The lawsuit demands judgment for an amount exceeding $50,000 plus interest and costs associated with the case. Furthermore, Godfrey is requesting a jury trial to resolve all issues presented in this matter.
