In a gripping legal battle unfolding in Palm Beach County, Florida, a local resident has filed a lawsuit against a major supermarket chain following an alleged incident that left him injured. Greg Gatto, the plaintiff, lodged his complaint on October 8, 2025, against Publix Super Markets, Inc., asserting negligence on their part after he sustained injuries at one of their locations.

The lawsuit was filed in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County. According to the complaint, Gatto claims that on October 9, 2023, while visiting the Publix Super Market at Oriole Plaza in Delray Beach as a business invitee, he encountered hazardous conditions that led to his injury. The document states that Gatto slipped and fell on wet toilet paper left on the floor of the men’s restroom. This fall resulted in him striking his head against a stall door and suffering a laceration along his forehead.

Gatto alleges that Publix failed to properly inspect and maintain their premises, leading to what he describes as “a dangerous condition” persisting for an unreasonable amount of time. The complaint further accuses Publix of neglecting its duty to ensure customer safety by not warning patrons about potential hazards or taking adequate measures to prevent such incidents. “Publix owed the Plaintiff a legal duty of reasonable care,” reads the complaint, which lists several specific failures including inadequate inspection routines and insufficient warning signage.

The legal filing argues that these oversights directly contributed to Gatto’s injuries. He reports suffering from physical pain, disfigurement due to scarring, mental anguish, and financial losses stemming from medical expenses and lost income. Asserting that these injuries are permanent and will continue affecting him in the future, Gatto seeks judgment for damages exceeding $50,000. Additionally, he requests compensation for court costs and prejudgment interest where applicable.
