Plaintiff alleges supermarket chain’s negligence after trip-and-fall incident

A slip and fall incident at a supermarket has led to a lawsuit seeking over $50,000 in damages. On August 27, 2025, Adela Martinez filed a complaint against Publix Super Markets, Inc. in the Circuit Court for the Fifteenth Judicial Circuit in Palm Beach County, Florida. The case revolves around an alleged negligence on the part of Publix that resulted in Martinez’s injuries.

According to the court documents, Martinez claims that on May 29, 2025, she was walking on a walkway maintained by Publix at their location on PGA Boulevard in Palm Beach Gardens when she tripped over a raised paver. This fall allegedly caused her significant injuries. The complaint asserts that Publix had a “non-delegable duty” to ensure the safety of its premises but failed to maintain the walkway in a reasonably safe condition.

Martinez accuses Publix of several acts of negligence. She alleges that they failed to properly maintain or inspect the walkway, which created an unreasonably dangerous condition for pedestrians like herself. Furthermore, she claims that Publix did not warn her about this hazard and failed to correct it despite knowing—or having sufficient time to know—about its existence. The complaint also mentions inadequate staffing and training concerning the inspection and maintenance of such walkways as contributing factors.

The plaintiff is seeking compensation for various damages resulting from her fall. These include bodily injury leading to pain and suffering, disability, disfigurement, permanent scarring, mental anguish, loss of enjoyment of life, medical expenses, loss of earnings and earning capacity, and aggravation of pre-existing conditions. Martinez contends that these injuries are either permanent or ongoing and will continue to affect her life.
