A Florida resident has taken legal action against a prominent supermarket chain following an alleged slip-and-fall incident that left her with significant injuries. On October 10, 2025, Anecia Lewis filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, accusing The Fresh Market, Inc. of negligence related to unsafe conditions at their Palm Beach Gardens location.
According to the complaint, Lewis claims that on October 12, 2023, she was a lawful business invitee at The Fresh Market located at 4925 PGA Boulevard when she slipped and fell due to an “unreasonably slippery floor.” The lawsuit details that Lewis had just finished paying for her breakfast and was walking towards the front of the store when the incident occurred around 11:30 a.m. She asserts that The Fresh Market failed in its duty to maintain a safe environment for customers by not ensuring that the floor was free from hazards such as wet or slippery surfaces.
The complaint outlines several allegations against The Fresh Market, including failing to maintain the floor in a reasonably safe condition, neglecting to provide adequate slip-resistant features on the floor, and not conducting timely inspections or cleaning. Additionally, it accuses the supermarket of failing to warn customers about the potential danger posed by the slippery floor. As a result of these alleged failures, Lewis states she suffered bodily injury leading to pain and suffering, disability, disfigurement, mental anguish, and incurred medical expenses.
Lewis is seeking judgment against The Fresh Market for both general and special damages in an amount yet to be determined at trial. She also requests compensation for past and future medical expenses related to her injuries. In her filing with attorney Marshall E. Rosenbach from North Palm Beach’s Law Offices of Marshall E. Rosenbach representing her interests, Lewis has demanded a jury trial.
This case will be presided over by Judge Michael A. Caruso under Case Number 502025CA010546XXXAMB Div: AG.
