DZM Auto Sales LLC, a Florida-based company, has taken legal action against two Texas entities over the alleged illegal confiscation of its vehicles, a move that it claims has devastated its business operations. The complaint was filed on August 26, 2025, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, naming Good Floor Loans LLC and PCAP Holdings LP as defendants.

The lawsuit revolves around accusations that the defendants unlawfully seized approximately thirty-eight vehicles from Level Up Auto Sales’ lot in St. Petersburg on September 5, 2024. Among these were twenty-two vehicles owned by DZM Auto Sales LLC. According to the complaint, this act of repossession was not only unauthorized but also carried out with full knowledge that the vehicles did not belong to Level Up Auto Sales (LUAS). This seizure reportedly led to a cascade of financial difficulties for DZM, including defaulting on loans and having their remaining inventory repossessed by their lender NextGear Capital Inc., resulting in debts exceeding $150,000.

DZM’s complaint accuses Good Floor Loans LLC and PCAP Holdings LP of civil theft under Florida law for unlawfully taking possession of its property with intent to deprive them temporarily or permanently. The plaintiff further alleges conversion and negligence on part of the defendants for failing to verify ownership before seizing the vehicles and subsequently refusing to return them despite being notified multiple times. Additionally, DZM claims tortious interference with business relationships due to this incident causing disruptions with LUAS and NextGear.

The plaintiff is seeking various forms of relief from the court including treble damages for civil theft as per Florida Statute 772.11, compensatory damages for conversion and negligence, pre- and post-judgment interest, attorneys’ fees and costs. They argue that these actions have caused significant financial harm including loss of business opportunities and profits.
