Plaintiff injured customer sues Home Depot for negligence over defective shopping cart incident

A Pinellas County resident has filed a lawsuit against a major retail corporation following an alleged injury on the store’s premises. On November 3, 2025, Jason Kamal Laurence lodged a complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, against Home Depot U.S.A., Inc., and an unidentified individual referred to as John Doe.

The incident at the heart of this legal battle occurred on November 25, 2024. Laurence claims that while visiting a Home Depot store as a customer, he was struck by roofing tiles that fell due to the actions of John Doe. The plaintiff asserts that these tiles were dropped because of a defective shopping cart provided by Home Depot. Laurence alleges that Home Depot had either actual or constructive knowledge of this dangerous condition but failed to take appropriate measures to rectify it or warn customers.

According to the complaint, Home Depot is accused of negligence for not maintaining their property in a safe condition and failing to provide non-defective shopping carts. The lawsuit further accuses them of not informing John Doe about the defective cart, which ultimately led to Laurence’s injuries. These injuries are described as significant and permanent, including pain and suffering, disability, disfigurement, mental anguish, loss of earnings and earning capacity, medical expenses for treatment and diagnostic testing, and aggravation of pre-existing conditions.

Laurence seeks damages exceeding $50,000 from both defendants. He demands compensation for his past and future suffering due to what he describes as permanent personal injuries with lasting impacts on his life quality and financial stability. Additionally, he requests costs related to his medical care and other associated expenses.
