A harrowing incident at a Florida elementary school has led to a lawsuit against the local school district, as a mother seeks justice for her young daughter. Bettie Limage filed a complaint on October 8, 2025, in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, accusing The School District of Palm Beach County of negligence that resulted in severe injuries to her six-year-old daughter, A.D.

According to the complaint, on December 11, 2023, A.D., a student at Banyan Creek Elementary School, suffered traumatic injuries while under the supervision of school staff. The lawsuit claims that A.D. was not properly supervised and sustained serious and permanent injuries to her vaginal area due to an unsafe chair. Bettie Limage alleges that despite notifying school personnel immediately after the incident, they failed to report it to the Department of Children and Families as required by law. This failure allegedly violated both school policy and Florida statutes.

The plaintiff’s attorney argues that the School Board had a duty of care towards its students which it breached through various acts of negligence. These include failing to provide adequate supervision for minor students like A.D., not training teachers properly in student supervision, and neglecting to maintain safe premises by inspecting chairs and equipment regularly. The complaint also highlights that previous similar incidents were not addressed adequately by implementing safety measures or protocols.

Bettie Limage is seeking damages exceeding $50,001 for her daughter’s physical pain and suffering, mental anguish, medical expenses, and loss of enjoyment of life among other claims. She demands judgment against The School District of Palm Beach County for these damages along with taxable costs and interest permissible under Florida law. Additionally, she requests a jury trial for all issues triable by right.

Representing Bettie Limage is attorney Victoria San Pedro Madani from Abogadas305 law firm based in Coral Gables, Florida. The case has been assigned Case Number 502025CA010413XXXAMB Div: AE with Judge Michael A. Caruso presiding over proceedings.
