Plaintiff sues Oldsmar Track for Negligence after Incident at Flea Market

Carmen A. Rivera Santaella has taken legal action against a Florida-based corporation following an incident that left her with permanent injuries. On October 16, 2025, Santaella filed a complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, accusing Oldsmar Track, LLC of negligence after she tripped over uneven pavement at their premises.

According to the lawsuit, Carmen A. Rivera Santaella was visiting the Oldsmar Flea Market on December 8, 2024, when she encountered broken and uneven pavement. This hazardous condition caused her to fall and sustain significant bodily harm. The plaintiff claims that Oldsmar Track, LLC failed in its duty to maintain safe premises for its patrons and neglected to warn visitors about the dangerous conditions present at their location on Racetrack Road in Oldsmar, Florida.

The complaint elaborates on several points of negligence by Oldsmar Track, LLC. It asserts that the company should have been aware of the hazardous pavement due to its prolonged existence and failed to take corrective measures or provide adequate warnings. “The Defendant owed a duty to the Plaintiff to make sure its Premises is free of dangerous conditions,” states the filing. The lawsuit further accuses Oldsmar Track of not conducting proper inspections and neglecting to place warning signs around the area where Santaella fell.

As a result of this alleged negligence, Santaella claims she has endured ongoing physical injuries along with mental anguish and emotional distress. She also cites a loss of enjoyment in life and diminished earning capacity as consequences of her injuries. The complaint seeks damages exceeding $50,000 for these enduring impacts as well as coverage for past and future medical expenses related to her injuries.

Santaella’s legal representation is being handled by Martin Tapia from Farah and Farah, P.A., who has demanded a jury trial for all issues deemed triable under law. The case number assigned is 25-005835-CI.
