Plaintiffs Allege Negligence Against BJ’s Wholesale Club Following Injury

A Florida couple has filed a lawsuit against a well-known wholesale club, alleging negligence that led to a serious injury. Marietta and Ralph Falcone filed the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on October 10, 2025, targeting BJ’s Wholesale Club, Inc., and its manager Leanne Johnson.

The case revolves around an incident that occurred on May 26, 2025, at a BJ’s Wholesale Club store located at 500 N State Road 7 in Royal Palm Beach, Florida. Marietta Falcone claims she was injured after tripping over unattended items in one of the shopping aisles managed by Leanne Johnson. The plaintiffs argue that both BJ’s Wholesale Club and Johnson failed to maintain safe premises and neglected their duty to warn patrons of potential hazards. “The Defendants… had a duty to exercise reasonable care to ensure that the subject premises… were safe and free of any dangerous conditions,” the complaint states.

According to the lawsuit, Marietta Falcone suffered serious bodily injuries due to this alleged negligence. The plaintiffs assert that BJ’s Wholesale Club knew or should have known about the hazardous condition posed by items left on the floor but failed to address it adequately. They claim this oversight resulted in Marietta’s fall and subsequent injuries. The complaint details various breaches of duty by BJ’s Wholesale Club, including failing to properly train employees and maintain safe aisle conditions.

In addition to compensatory damages for Marietta’s injuries, the Falcones are seeking economic damages for medical expenses incurred and anticipated future costs. They also demand compensation for lost wages and loss of earning capacity due to Marietta’s injuries. Furthermore, Ralph Falcone is pursuing damages for loss of consortium, citing the impact his wife’s injuries have had on their marital relationship.
