A couple from Palm Beach County has filed a lawsuit against two golf clubs, alleging negligence that led to severe injuries. On October 9, 2025, Bonnie Balkin and her husband Michael Balkin lodged their complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, targeting Via Mizner Golf & Country Club, LLC and Penn Florida Club Properties II, LLC.

The incident at the heart of this legal battle occurred on December 7, 2024. Bonnie Balkin was enjoying a round of golf at the Via Mizner Golf & Country Club when she slipped on wax-coated pine straw placed around trees on the course. The fall resulted in a fractured ankle requiring surgery and an extended hospital stay. The plaintiffs argue that the defendants were aware of the slippery nature of the pine straw but failed to provide any warnings or take preventive measures to ensure guest safety. According to court documents, managers at the club acknowledged their oversight in not warning about these hazards despite being aware of them.

The lawsuit claims that both defendants were engaged in a joint venture and are thus jointly responsible for maintaining safe conditions on their property. The complaint highlights several alleged failures by the defendants: choosing to use slippery materials without proper testing or warnings, inadequate supervision and inspection of hazardous areas, and insufficient training of staff regarding safety protocols. These actions or lack thereof constitute breaches of duty owed to guests like Bonnie Balkin.

Bonnie Balkin seeks compensation for various damages including pain and suffering, medical expenses, loss of earnings, and diminished quality of life due to her injuries. Her husband Michael is also seeking damages for loss of consortium—his wife’s companionship and support—resulting from her incapacitation.

Represented by attorney David J. Zappitell from Zappitell Law Firm P.L., the plaintiffs demand a jury trial and seek damages exceeding $50,000 excluding interest and costs. The case is filed under Case Number 502025CA010446XXXAMB Div: AF with Judge Michael A. Caruso presiding over proceedings.
