Plaintiffs Allege Negligence Against Landlords Over Hazardous Living Conditions

Cristina Tlotoa, along with her children and Richard Morfa, have filed a lawsuit against a couple in Palm Beach County Circuit Court on October 8, 2025. The complaint accuses the defendants of negligence and premises liability related to severe water damage and mold infestation in their rental property. The plaintiffs allege that these conditions have caused significant harm to their health and personal belongings.

The plaintiffs’ story begins in November 2023 when they reported significant water leaks from the walls and roof of their rented property to the defendants. Despite repeated complaints, particularly after a hurricane in October 2024, about visible mold and a strong odor affecting the children’s bedrooms, the defendants allegedly failed to address these issues. The continuous water intrusion reportedly damaged furniture, kitchenware, and other personal items within the property. Moreover, hazardous conditions like slippery floors led to one plaintiff suffering injuries from a fall.

The lawsuit claims that toxic mold proliferated due to persistent water leaks, deteriorating the plaintiffs’ health and aggravating pre-existing conditions. It is alleged that the defendants had secured homeowner’s insurance with Heritage Insurance Policy Number HPDO14056 for such eventualities but did not act upon it effectively. The plaintiffs accuse the defendants of breaching their duty of care by failing to repair known defects timely, inspect for damage adequately, remediate mold professionally, warn about dangerous conditions like mold presence, and fix ongoing leaks causing slippery floors.

In terms of legal relief sought, the plaintiffs demand damages exceeding $50,000 exclusive of interest and legal costs. They are seeking compensation for unforeseen expenditures related to medical expenses and physical injuries incurred due to negligence. Furthermore, they demand post-judgment interest and coverage for litigation costs as permitted by law.
