A Florida woman has filed a lawsuit against a major supermarket chain, alleging negligence after suffering injuries from a fall in one of its stores. Kathleen Zollo lodged the complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on October 31, 2025, targeting Publix Super Markets, Inc.
The case stems from an incident that occurred on September 19, 2024, when Zollo was shopping at a Publix store located at 4701 Park Blvd in Pinellas Park. According to the complaint, while walking through the produce section at a normal pace and using the floor as intended, Zollo tripped over a display. This fall resulted in severe and lasting injuries. The lawsuit claims that Publix failed to maintain safe premises and neglected to provide adequate warnings about potential hazards created by their displays. “Defendant acted with less than reasonable care,” the complaint states, listing several alleged failures including improper maintenance and lack of caution signs.
Zollo accuses Publix of negligence/premises liability under Florida law. She asserts that Publix had a duty to ensure their premises were safe for customers like her but failed to do so. The legal document highlights multiple instances where Publix allegedly did not act responsibly—such as failing to conduct reasonable inspections or warn customers about dangerous conditions—which led directly to her injuries. As a result of this negligence, Zollo claims she suffered bodily injury, great physical pain and suffering, disability, mental anguish, and incurred medical expenses.
In her lawsuit, Zollo seeks damages exceeding $50,000 for general damages along with costs and interests related to her injuries. She demands judgment against Publix for failing to exercise reasonable care that could have prevented her accident and subsequent suffering. Furthermore, she requests a jury trial on all issues presented in her case.
