Johanna Rodriguez, a resident of Pinellas County, Florida, has filed a lawsuit against two companies responsible for managing her apartment complex. The complaint was filed on October 27, 2025, in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida. Rodriguez accuses Chesapeake Apartments LLC and Burton Carol Management LLC of negligence that led to her suffering significant injuries.
The incident in question occurred on May 1, 2024, at the apartment complex located at 2259 Primrose Lane in Clearwater, Florida. Rodriguez claims she tripped and fell due to a hazardous condition on the premises—a hole that was not properly maintained or marked by the defendants. As per the complaint, both Chesapeake Apartments LLC and Burton Carol Management LLC had an obligation to ensure that the property was safe for residents and their guests. They allegedly failed to uphold this duty by neglecting routine inspections and maintenance of walkways and other areas accessible to tenants.
Rodriguez’s complaint outlines several accusations against the defendants. It alleges that they were negligent in maintaining the premises by allowing dangerous conditions like unmarked holes to exist without adequate warning or repair. The lawsuit also highlights failures in following established safety protocols and training employees adequately to identify and mitigate such hazards. “Negligently failing to maintain or adequately maintain the Subject Premises,” reads one part of the document, emphasizing how these oversights directly contributed to Rodriguez’s accident.
The plaintiff is seeking damages exceeding $50,000 from each defendant as compensation for her injuries which include pain and suffering, permanent disfigurement, mental anguish, medical expenses, loss of earnings capacity, among others. She asserts that these damages are ongoing and will continue into the future due to their permanent nature.
