In a gripping legal confrontation, a resident of Pinellas County has taken her homeowners’ association to court over an alleged slip-and-fall incident that left her with significant injuries. Allison Peck filed a complaint on November 3, 2025, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, against Bahia Del Mar Homeowners’ Association, Inc., claiming negligence on their part.

The lawsuit stems from an incident that occurred on October 4, 2024, when Peck entered building #6291 at the Club Bahia condominiums and slipped on a foreign substance near the elevators. The fall resulted in bodily injuries for which she is seeking compensation. Peck’s complaint asserts that the homeowners’ association failed to maintain safe premises and neglected to warn residents of potential hazards. “Defendant owed Plaintiff a nondelegable duty to exercise reasonable care for her safety,” reads the complaint.

Peck accuses Bahia Del Mar Homeowners’ Association of multiple lapses in their duty of care. These include failing to maintain the flooring adequately, not inspecting or warning about dangerous conditions, and neglecting to train staff properly. The lawsuit highlights specific allegations such as “negligently failing to have adequate policies in place” and “negligently selecting flooring that failed to provide a non-slip surface.” According to Peck’s attorney, Joseph A. Kopacz from Morgan & Morgan P.A., these failures directly contributed to her injuries.

The plaintiff seeks damages exceeding $50,000 for pain and suffering, medical expenses, loss of earnings, and other related costs. She demands a jury trial to determine fair compensation for her losses which are described as permanent or continuing.

Represented by Joseph A. Kopacz from Morgan & Morgan P.A., Allison Peck is determined to hold Bahia Del Mar Homeowners’ Association accountable for what she claims is negligence leading to her injury. The case has been assigned Case Number: 25-006206-CI and will be presided over by judges within the Sixth Judicial Circuit Court in Pinellas County.
