Restaurant Patron Alleges Negligence Against Popular Eatery Following Slip-and-Fall Incident

Iris Monica Settlemyre has taken legal action against a well-known Florida restaurant, alleging negligence after a slip-and-fall incident left her with significant injuries. On January 12, 2026, Settlemyre filed a complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, targeting Eugen’s Restaurants, Inc., doing business as E&E Stakeout Grill.

The case revolves around an unfortunate event that occurred on August 27, 2024. According to the complaint, Settlemyre was visiting E&E Stakeout Grill as a patron when she sought directions to the restroom. A staff member directed her down a dimly lit hallway where she encountered an unsecured small black rug. As she stepped onto it, the rug slipped beneath her feet, causing her to fall and sustain painful injuries. The plaintiff claims that the restaurant failed in its duty of care by not securing the rug or warning patrons about its potential hazard.

Settlemyre’s lawsuit accuses Eugen’s Restaurants of negligence for not maintaining safe premises and failing to warn of foreseeable dangers. The complaint outlines several breaches of duty: not securing the rug to the floor, neglecting to warn patrons about it, and failing to conduct reasonable inspections. It asserts that these oversights led directly to Settlemyre’s injuries which include bodily harm, pain and suffering, disability, disfigurement, loss of enjoyment of life, medical expenses, lost earnings capacity, and aggravation of pre-existing conditions.

In seeking justice from the court, Settlemyre demands judgment against Eugen’s Restaurants for damages exceeding $50,000. She also requests compensation for legal costs and any further relief deemed appropriate by the court. Additionally, she has called for a jury trial on all triable issues.
