Shopping Center Owners Accused of Negligence Following Employee’s Slip-and-Fall Incident

In a gripping legal battle that could redefine premises liability, Michael Mignacca has filed a lawsuit against three corporate entities following a serious injury at a popular shopping center. The complaint was lodged on February 26, 2026, in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida. The defendants named in the suit are P.B.G.S., LTD., PBGS, INC., and KISS REALTY, INC.

The case revolves around an incident that occurred on July 15, 2024, when Mignacca visited Gardens Towne Square as a business invitee and employee of Crazy Horse Saloon. During his visit, he slipped and fell on green algae and mud accumulated beneath a gutter spout and air conditioning drainage line in the parking lot area. This unfortunate event resulted in significant bodily injuries for Mignacca. The plaintiff claims that the defendants failed to maintain their premises safely and neglected to warn him of hazardous conditions. “Defendants owed a nondelegable duty to exercise reasonable care for his safety,” states the complaint.

Mignacca accuses the defendants of multiple acts of negligence including failing to maintain or adequately inspect the parking lot area where the slip occurred. He asserts that these oversights created an unreasonably dangerous condition for patrons like himself. Furthermore, Mignacca alleges that despite prior knowledge of similar incidents at the location due to transitory foreign substances or other hazards, no corrective measures were taken by the defendants.

The lawsuit seeks damages exceeding $50,000 from each defendant for pain and suffering, disability, disfigurement, mental anguish, medical expenses, loss of earnings both past and future, and permanent impairment. Mignacca demands a jury trial to determine just compensation for his injuries under Article 1 Section 21 of the Florida Constitution.

Representing Mignacca is Benjamin Cohen from Morgan & Morgan P.A., known for advocating on behalf of individuals against large corporations. The case is being presided over by Judge Michael A. Caruso under Case ID: 502026CA002307XXXAMB Div: AD.
