A slip-and-fall incident at a Clearwater grocery store has led to a legal battle over alleged negligence. Todd Schantz filed a complaint against ALDI (Florida) L.L.C. in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on January 30, 2026. The lawsuit accuses ALDI of failing to maintain safe premises, leading to Schantz’s injuries.
According to the complaint, Todd Schantz claims that on June 14, 2025, he was visiting an ALDI store located at 2150 Gulf to Bay Blvd in Clearwater when he slipped and fell due to a transitory foreign substance on the floor. The lawsuit asserts that this substance created an unreasonably dangerous condition that ALDI failed to address adequately. Schantz argues that as a business invitee, he was owed a duty of care by ALDI to ensure his safety while on their premises.
The complaint outlines several allegations against ALDI, including negligent maintenance of the floor and cooler areas where the incident occurred. It claims that ALDI failed to inspect or warn about potential hazards and did not take appropriate measures to correct or prevent such dangerous conditions. Specifically, it is alleged that there was a leaking cooler contributing to the hazardous environment. “Negligently failing to maintain or adequately maintain the cooler” is one of several points listed as breaches of duty by ALDI.
Schantz is seeking damages exceeding $50,000 for various injuries sustained from the fall. These include bodily injury resulting in pain and suffering, disability, disfigurement, mental anguish, permanent scarring, loss of enjoyment of life, medical expenses, and loss of earnings capacity. The complaint emphasizes that these injuries are either permanent or ongoing and will continue affecting Schantz into the future.
The plaintiff’s legal representation is provided by Alicia M. Smith from Farah & Farah law firm based in Orlando. The case has been assigned Case Number: 26-000600-CI and will be heard by judges within the Sixth Judicial Circuit Court in Pinellas County.
