Toni West Accuses Retail Giant Home Depot of Negligence Following Store Incident

Toni West, a resident of Pinellas County, Florida, has filed a lawsuit against Home Depot U.S.A., Inc. The complaint was lodged in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida on October 28, 2025. West accuses Home Depot of negligence following an incident at their Clearwater store that resulted in significant injuries.

According to the complaint, on September 23, 2024, Toni West visited the Home Depot located at 30144 US Highway 19 North in Clearwater as a business invitee. During her visit, she tripped over a damaged mat left on the floor of the store. West claims that Home Depot failed to maintain its premises safely and did not warn customers about the hazardous condition posed by the mat. The lawsuit alleges that Home Depot breached its duty to provide a safe environment by allowing such dangerous conditions to exist and failing to take corrective measures.

The complaint outlines several specific accusations against Home Depot. It states that the company neglected to maintain the floor in a reasonably safe condition by leaving items like the damaged mat unattended. Furthermore, it accuses Home Depot of failing to warn customers about this danger or place appropriate safety markers such as barricades or wet floor signs. Additionally, West asserts that Home Depot did not remove or correct the hazardous condition despite knowing—or having reason to know—of its existence due to regular public visits.

As a result of this alleged negligence, Toni West suffered severe injuries including physical and mental pain and suffering, disability, disfigurement, loss of enjoyment of life, and impairment of earning capacity. She also incurred medical expenses related to her injuries which are described as permanent or continuing in nature.

West is seeking damages exceeding $50,000 exclusive of interest and costs from Home Depot for these injuries. She demands judgment for damages along with costs and interest as well as any other relief deemed appropriate by the court.
